The Ministry of Defense of Ukraine has tightened requirements for defense contract executors who have debts in enforcement proceedings and whose enforcement actions are suspended during martial law.

Additional criteria have been introduced to define such enterprises: the volume of production of defense-related goods, works, and services must exceed 50% of the total production volume for the last reporting period.
The relevant changes were introduced in December 2025. At the initiative of the Ministry of Defense, the Cabinet of Ministers of Ukraine adopted a resolution regulating the “Procedure for determining defense industry enterprises that are debtors in enforcement proceedings, for which enforcement actions are suspended during martial law” (hereinafter — the Procedure).
The Ministry of Defense of Ukraine received the relevant powers following the liquidation of the Ministry of Strategic Industries of Ukraine.
Practical application of the Procedure showed the need for amendments that clearly emphasize its application specifically to enterprises for which the production of defense goods, performance of defense-related work, and provision of defense services constitute their core activity. Therefore, MoD specialists developed appropriate amendments to the regulatory framework.
From now on, a defense contract executor must simultaneously meet three criteria:
